Terms of Use

1. Agreement to these Terms

These Terms of Use govern your use of the Cafiqo mobile application, website, and related services (together, “Cafiqo” or the “Service”), provided by Kaihzan-Nixxo Jamilla (“we,” “us,” or “our”). By creating an account or using Cafiqo, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Cafiqo.

2. Who may use Cafiqo

You must be at least 13 years old to use Cafiqo. If you are under the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms where required by law. You may not use account-based features if local law requires parental consent and that consent has not been obtained.

4. Accounts and security

After onboarding, you must register a Cafiqo account with an email address and password before using either the free tier or Cafiqo Pro. The subscription purchase screen appears before registration. Cafiqo creates a temporary internal account identifier during onboarding so that a purchase can be associated with you. After you purchase or dismiss the subscription screen, you must finish registration before entering the app. Purchasing a subscription does not remove the account requirement. You must provide accurate information, protect your password, and promptly tell us of suspected unauthorized access. You are responsible for activity under your account to the extent permitted by law. You may delete your account from the app at any time; see our account-deletion instructions.

5. Snap AI and submitted photos

Snap AI uses automated systems to identify a beverage and estimate serving size and caffeine. Results may be inaccurate, incomplete, or unavailable and must be reviewed before you rely on them. Photograph beverages only. Do not submit faces, identification documents, private surroundings, or other personal or sensitive information.

You retain ownership of photos and other content you submit. You give us a limited, worldwide license to host, copy, process, resize, and transmit that content only as needed to operate, secure, and improve the requested Cafiqo features. You represent that you have the right to submit the content and that it does not violate law or another person’s rights.

6. Cafiqo Pro subscriptions

Cafiqo offers optional monthly and annual auto-renewable Cafiqo Pro subscriptions. Both plans unlock the same Pro features: unlimited Snap AI beverage analyses, all five reminder types, Home Screen widgets, Live Activities, and the Insights tab. The plans differ only in billing period and trial availability. Pro features may require a compatible device, operating-system support, internet access, and applicable permissions.

The free tier includes up to three Snap AI beverage analyses in total and log reminders. After those three analyses have been used, additional Snap AI analyses require an active Cafiqo Pro subscription. The other four reminder types, Home Screen widgets, Live Activities, and the Insights tab also require an active Cafiqo Pro subscription. Basic drink logging and other features identified as free remain available if Cafiqo Pro expires.

The annual plan may include a three-day introductory free trial for eligible customers when displayed on the purchase screen. The monthly plan does not include a free trial and is charged immediately upon purchase. Trial eligibility is determined by Apple for the applicable subscription group. Unless cancelled, an annual trial converts to the annual paid subscription at the price displayed before purchase.

Monthly subscriptions renew monthly, and annual subscriptions renew annually, unless cancelled. The localized price, currency, billing period, trial eligibility, and amount displayed through Apple at the time of purchase control the transaction. Any monthly-equivalent amount shown for the annual plan is provided only for comparison; the annual subscription is billed as one annual charge. Unlimited features remain subject to reasonable technical, security, and acceptable-use limits.

Apple processes payment through your Apple Account. Manage or cancel your subscription in your Apple subscription settings. To avoid a renewal charge, cancel at least 24 hours before the current billing period ends. Deleting Cafiqo or your Cafiqo account does not cancel an Apple subscription. Refunds and billing disputes are handled under Apple’s applicable policies and mandatory law.

When a purchase is made before email registration, Cafiqo associates it with the temporary internal account identifier created during onboarding. Completing registration converts that same identifier into your email-and-password account without changing its identity. You must complete registration to enter Cafiqo and use Pro features. To restore access on another device, sign in to that same Cafiqo account and use Restore Purchases. A subscription already associated with one registered Cafiqo account cannot be claimed by a different Cafiqo account. If the App Store account on a shared device already has a Cafiqo subscription, the other person must sign in to the original Cafiqo account or use their own App Store account.

7. Acceptable use

You may not:

• use Cafiqo unlawfully, fraudulently, or to harm another person;
• submit content you do not have the right to use;
• probe, disrupt, overload, or bypass Service security;
• scrape, resell, or commercially exploit the Service or its data;
• reverse engineer Cafiqo except where that restriction is prohibited by law; or
• use automated output as medical advice or represent it as certain.

8. Our intellectual property

Cafiqo, including its software, design, branding, text, graphics, calculations, and curated beverage data, is owned by us or our licensors and protected by applicable intellectual-property laws. These Terms grant you a personal, limited, revocable, non-transferable, non-exclusive license to use Cafiqo for its intended purpose. No other rights are granted.

9. Third-party services and Apple terms

Cafiqo depends on services supplied by Apple and other providers, including hosting, analytics, subscriptions, and AI processing. Their availability and terms may affect Cafiqo. An App Store download is also subject to Apple’s Standard Licensed Application End User License Agreement. Apple is not responsible for providing Cafiqo support.

10. Changes, availability, and termination

We may improve, change, suspend, or discontinue features for product, legal, security, or technical reasons. We do not promise that Cafiqo will always be uninterrupted, error-free, or compatible with every device. We may suspend or terminate access when reasonably necessary to protect users, the Service, or comply with law. You may stop using Cafiqo and delete your account at any time.

11. Disclaimers and limitation of liability

To the maximum extent permitted by law, Cafiqo is provided “as is” and “as available,” without warranties of accuracy, reliability, availability, merchantability, fitness for a particular purpose, or non-infringement. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for losses caused by reliance on estimated caffeine information or automated output.

Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded. Where liability cannot be excluded, it is limited to the greater of the amount you paid for Cafiqo during the 12 months before the claim or the minimum amount required by law.

12. Governing law

These Terms are governed by the laws of the Philippines, without regard to conflict-of-law rules. Courts with jurisdiction in the Philippines may hear disputes, but this does not deprive you of any mandatory consumer protection or right to bring a claim available under the laws where you live.

13. Changes to these Terms

We may update these Terms. We will post the revised version and update its effective date, and provide additional notice when required. If a material change requires consent, we will request it. Continued use after an update takes effect constitutes acceptance where permitted by law.
